SCI Learns of New Date for Impending FWS Decision on Zimbabwe’s Elephant Importation Ban

elephantsatwaterfirstforhunters052114SCI reported several weeks ago that the U.S. Fish and Wildlife Service had announced that the agency was preparing to announce a new decision on whether it would continue or lift the importation ban for Zimbabwe’s elephants. In documents filed in SCI’s litigation challenge to the importation ban, the FWS informed the court that it would make that new decision by “mid-July.” Last week, SCI received additional information on the date that this decision would be announced. In an e-mail from Department of Justice attorneys, SCI learned that the FWS has made its decision and will submit a notice for publication of that decision in the Federal Register by Friday of this week (July 25, 2014). Note that it may take a while for the public to see that decision as it often takes days to weeks for the Federal Register to publish the notices that federal agencies post for publication.

For the last several weeks, the FWS has been reviewing information, obtained directly from Zimbabwe and supplemented by SCI and others, regarding the country’s elephant management.  SCI’s lawsuit has aggressively pushed the FWS to move forward with its consideration of the Zimbabwe importation ban. The Service’s decision as to whether it will continue or lift the ban will depend on its analysis of these documents.

We know that many of our members are waiting for the Service to make up its mind.  As soon as the Service announces its decision, we will immediately inform our membership.  In the meantime, if the Service does not announce a decision soon, SCI’s attorneys will consider possible action to force a decision.  And, of course, if the decision is to continue the ban, SCI will amend its lawsuit, if necessary to assert our challenge to this new decision.
